In the constitution there are a total of 10 amendments. I believe that the first eight of the amendments should be kept and protected. They protect our personal freedoms but with some limitations. The bill of rights were designed to protect all of our individual rights in our democracy. It's the government's jobs to protect us. We are a nation of the people for the people and by the people .
The first amendment gives you the freedom of religion, speech and for the press, and also the right to peacefully assemble. Our democracy is based on these freedoms. We have the right to practice any religion we want, and to speak what's on our mind. Also, we have the right to gather as a group and protest. The limitation against that is people can not become violent while protesting. We should be able to follow in our own religion and pray without any interference. This amendment is important to our society because it gives us the freedom as individuals in certain ways without taking away our basic rights as a citizen of the United States. Even though we have the freedom of speech you can not yell anything inappropriate in certain places or at school. An example of a limitation is when someone yells, “FIRE” when everything is okay. A Core Democratic Value that applies best to the first amendment is Individual Rights. It states that we the people of the United States have our own rights to Life, Liberty, Economic Freedom, and the Pursuit of Happiness and they shall be protected by the government.
The right to bear arms is the second amendment, this means that the U.S constitution protects the right of individuals, and the right to own and carry a weapon. Its our right to protect ourselves, our family and our personal belongings. A restriction for the second amendment is certain guns can be band but no state can take away the second amendment right. Also, you can be fined when carrying a gun while hunting if you do not have a license. This is why I think that this amendment is greatly significant in our Constitution.
The third amendment fairly states, quartering soldiers in homes. A soldier may only be quartered at home with the approval of the owner, but the government can't make the soldier live at home during war. For example, during a war no soldier has to be forced to stay at home unless an acceptance from an owner. This means that soldiers could be quartered in homes if we had a law and the senate approves. This also means to balance private property rights. A limitation is that the government can't force the third amendment. This is important to our society because it accepts the right to private property.
The right of the people, searches and seizures is the fourth amendment. This amendment means, the government can not search your house unless a fair reason and it protects people from unreasonable seizures and searches by the government. The government should be able to exercise the right to intercede when there is justification of individuals plotting to do harm to US citizens, an example would be terrorists. A limitation is, when there is a question about a terrorist and there's reasonable doubt. A core Democratic Value that would most rely to the fourth amendment is Common Good. This means that laws should be made by the government that are good for everyone. This is a fair and important amendment because you should not be worried about someone searching your house unless you know you did something unacceptable. Also, nobody has the right just to search you and your personal belongings unless its reasonable by the laws. Again this amendment protects our personal rights to live in this country and this is why it it greatly important.
The fifth amendment is legal rights, and it creates many rights important to both civil and criminal legal proceedings. During criminal cases this amendment assures the right to a grand jury. For example, a grand jury must be present and must have a cause for blame or accusation before a person can go to trial when they are accused of a capital crime. Justice is a Core Democratic Value that best represents this amendment. It means that no favoritizing groups should be shown and all people should be treated fairly even when improving or correcting wrongs. A limitation is that you can not be a witness against yourself and you can't be tried for the same crime twice. The importance of the fifth amendment is that it protects us from unfair treatment.
Criminal trial rights is the sixth amendment. In all criminal prosecutions the accused has the right to a public and a speedy trial. The trial shall be lead by an impartial jury in the state, which the crime was committed. You have the right to a trial and the right to a lawyer to defend you. This is important because this amendment protects citizens in judicial affairs. An example would be, if someone accused you of stealing you have the right to defend yourself with the things outlined in this amendment. The limitations would be all of the laws that are imposed to the process of the case.
The seventh amendment is in regards to common law and civil lawsuits. If you are being sued more than twenty dollars you are then guaranteed a trial if needed. Examples of civil cases are, car accidents, the seek of money and etc. A limitation would be the abuse of the amendment. This is important to our society because, it protects man from abuse.
The death penalty is the eighth amendment. This means if you commit a crime you will get killed. For example, if a person kills you instead of going to jail you will be killed. The limitation for the eighth amendment is how much the judge can prescribe legal punishments or penalty($). Also, there can be no outrageous rulings. This amendment is important to our society because it works to protect us from potential tyranny from the government
In conclusion all of the fundamental rights should be protected even though there will always be controversy. Although sometimes people try to manipulate the law. I believe that the first eight amendments protect the individual rights and freedoms. Therefore, they should be protected by the government.
